Saudi Premium Residency Exceptions: Property, Revocation, Limits

The exceptions to Saudi Premium Residency are what promotional articles skip and holders discover late: property-ownership limits in Makkah, Madinah and border zones, the grounds on which the residency can be terminated or revoked, and the rights it does not confer despite its broad benefits. This 2026 guide maps the exceptions as set by the Kingdom's laws and the Premium Residency Center, with the legal playbook for protecting your residency from revocation.

Real Estate Ownership Exceptions

Premium Residency holders may own real estate across the Kingdom, with defined exceptions: in Makkah and Madinah ownership is excluded and the holder's right is limited to usufruct for the duration of the residency, while border zones and specially designated areas remain restricted. Even after the Non-Saudi Real Estate Ownership Law and its 2026 expansion, the two Holy Cities retain their exception. If your investment thesis centers on Makkah or Madinah, structure it around long-term, well-drafted usufruct arrangements rather than title ownership.

The Product Fee Is Not Eligibility: The Truth About SAR 4,000

The most common misconception is that the newer categories are available for a nominal fee. SAR 4,000 is the category processing fee; eligibility is independent and strict, including the talent points table, the SAR 7 million investment floor for Investors, the SAR 4 million unmortgaged property threshold for Real Estate Owners, and the hiring commitments for Entrepreneurs. Paying the fee with an incomplete file leads to rejection, not residency.

Grounds for Termination and Revocation

Ground

What it means

Your protective shield

Loss of the qualifying basis

Selling or mortgaging the qualifying property, its value falling below the threshold, or liquidating the investment

Never dispose of the qualifying asset before legal review; arrange a compliant substitute first

Breach of continuing criteria

Losing category conditions such as the Entrepreneur hiring commitments

An annual, documented compliance calendar

Criminal record and conduct

Convictions touching the good-conduct condition

Compliance and careful choice of partners

Misrepresentation in the application

Incorrect data or documents at filing

File accuracy from day one; revocation here carries the harshest effect

Discretionary authority of the Center

The board may terminate residency where the law and public interest so require

A clean file, and formal objection channels if a decision issues

What Premium Residency Does Not Grant

  • Saudi citizenship: it is a residency status, not an automatic naturalization track.

  • Jobs and activities reserved for Saudis: Saudization rules apply within their scope.

  • Exemption from professional licensing: law, medicine, engineering and other regulated professions keep their own requirements.

  • Immunity from the law: holders remain subject to all Kingdom regulations, and to tax and zakat according to their activities.

Legally Fortifying Your Residency

Premium Residency is a legal status to be managed, not a card to be filed away. Real Estate Owners need the accredited valuation preserved and the deed protected from any later mortgage; Investors need continuing thresholds and hires documented in minutes and reports; Entrepreneurs need their stake of 10% or more structured so later funding rounds do not dilute it below the line. That last point alone has cost holders their residency at the first uncounseled funding round. An annual legal review of the residency file costs a fraction of the battle to restore it.

From Our Practice

Most Premium Residency consultations reach us late rather than early: an investor who sold the qualifying property for a better deal and lost the basis of his residency; a founder diluted below 10% after a funding round; an applicant rejected over a valuation from a non-accredited firm who had to restart the journey. The rule we repeat: before any disposal of the qualifying asset, whether a sale, mortgage or exit, assess its effect on the residency first.

Frequently Asked Questions

Can I buy an apartment in Makkah with my Premium Residency?

No. Makkah and Madinah are excluded from ownership; your right there is usufruct for the duration of your residency, so build any Holy Cities investment on robust long-term usufruct contracts.

I want to sell my qualifying property. What happens to my residency?

The Real Estate Owner residency is tied to continued qualifying ownership; selling, mortgaging, or the value falling below the threshold exposes it to termination. Arrange a compliant alternative before the disposal, not after.

Can the residency be revoked over application errors?

Incorrect information is among the revocation grounds with the harshest effect. Build the file on documents from accredited sources, and correct any discovered error through formal channels immediately rather than ignoring it.

Is Premium Residency a path to Saudi citizenship?

It does not grant citizenship or an automatic preference toward it; naturalization is governed by its own separate rules. Premium Residency is a long-term residency and investment status with its defined benefits.
